ESM Solutions, Inc. d.b.a. ESM INSITE (“ESM”, “ESM Solutions”, “we”, “our” or “us”) are committed to respecting your privacy when you communicate. Please read this privacy policy carefully to understand our practices regarding your personal data and how we will treat it.

About our Privacy Policy

This privacy policy applies to your access to and use of ESM Solutions, Inc. including all content, services and products available at or through ESM Solutions, Inc.

This privacy policy, together with our Terms & Conditions sets out the basis on which any personal data we collect from you, or that you provide to us (whether directly or by authorized access), will be processed by us. By accessing and/or using ESM services and/or products, you are accepting and consenting to the practices described in this policy.

This privacy policy does not apply to websites, applications or mobile platforms that are not linked to this privacy policy or to those operated by third parties.

1. Information we collect

We collect information about you in three ways:

  • Profile information. Information you provided to sign up for participation within ESM including, but not limited to, your name, phone number, user name and identifier, domain and identifier, your email address, employer and position.

  • Shared channel content. We store content shared and discussed within ESM. We may also store the content of messages sent in the shared channels.

We may collect information directly from you, including:

  • Support information. We may store any communication between you and us that results from any support requests, including by way of phone, e-mail or otherwise.

When you remove, add or amend all or part of your personal data, our database may not be automatically updated with these changes. You must notify us separately.

3. Storage of your information

All personal data you provide to us is stored within ESM’s protected files, only available to administrators.

4. Disclosure of your information

We may need to disclose your personal information to:

  • Comply with any legal obligation or respond to law enforcement;

  • Investigate and help prevent security threats, fraud or other malicious activity;

  • To enforce and protect our rights and properties or apply our Terms & Conditions and other agreements;

  • Protect the rights, property or safety of ESM, our ESM users, employees or others; or

  • Prospective or actual purchasers of ESM or a related asset or line of business.

5. Payments and third-party payment processor

Your payments for ESM Solutions, Inc. products are processed by a third party credit card processor (e.g., Stripe and QuickBooks Online). All such transactions will be governed by the Stripe privacy policy at https://stripe.com/privacy and QuickBooks Online privacy policy at https://www.intuit.com/privacy/. We do not receive or store credit card information on our servers.

6. Editing and deletion of your information

If you wish to delete your account you may do so by contacting us . The cancellation will take effect the day after the last day of the current subscription period. Your personal information and any content you have discussed, contributed, shared or disseminated via the ESM platform will persist in its current form and/or archived data within ESM’s files as well as any applicable third party services you have provided it to.

7. Changes to your privacy policy

We reserve the right to change this policy at any time and for any reason. Any changes we may make to our privacy policy in the future will be notified to you by posting an updated version of this policy on this page with an updated revision date and, where appropriate, by email. Your continued use of, or access to, the ESM services platform following the notification of any changes to the Agreement constitutes acceptance to those changes.
